REGULATIONS OF THE ONLINE STORE pvcpro.eu

§ 1. GENERAL PROVISIONS

  1. These regulations define the basic principles of providing services and the terms and conditions of concluding a sales agreement applicable in the pvcpro.eu online store, operated by Salpark Sp. z o. o. with its registered office in Radom, ul. Chorzowska 17, 26-600 Radom, tel.: +48 48 386 68 88, NIP: 5252367659, REGON: 140505562, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000261557
  2. The Regulations are addressed to consumers and entrepreneurs using the pvcpro.eu online store.
  3. The administrator of personal data is the Service Provider, in accordance with these regulations.
  4. Providing personal data in the Online Store is voluntary, but necessary to complete orders.
  5. Every store user has the right to view, update and correct their personal data.

§ 2. DEFINITIONS

The following terms are used in the regulations:

  1. REGISTRATION FORM – a form in the IT system, the completion and sending of which to the Service Provider leads to the conclusion of a free user account management agreement.
  2. ORDER FORM – a document (including electronic forms) confirming acceptance of an order, specifying order parameters, such as the quantity and type of goods ordered, payment method, shipping method, customer details, and delivery address. This document serves as the basis for order fulfillment.
  3. SELLER/SERVICE PROVIDER – Salpark Sp. z o. o. with its registered office in Radom, ul. Chorzowska 17, 26-600 Radom, tel.: +48 48 386 68 88, NIP: 5252367659, REGON: 140505562, entered into the Register of Entrepreneurs of the National Court Register under the KRS number: 0000261557.
  4. CUSTOMER/USER – a natural person with full legal capacity, a legal person or an organizational unit with legal capacity who uses or intends to use the Electronic Service.
  5. WORKING DAYS – days from Monday to Friday, excluding public holidays.
  6. REGULATIONS – this document defining the rules applicable in the pvcpro.eu online store.
  7. USER ACCOUNT – resources and permissions in the online store system, assigned to a given user.
  8. COURIER COMPANY – an entity providing transport and delivery services as part of business activities.
  9. SALES AGREEMENT – a sales agreement within the meaning of the Civil Code, concluded upon acceptance of the regulations and confirmation of the order details by the BUYER by clicking on the link sent in the order confirmation.
  10. PAYMENT DATE – the date by which the order amount paid by the Customer must be credited to the Seller’s account.
  11. CIVIL CODE – Act of 23 April 1964 (Journal of Laws of 1964, No. 16, item 93, as amended).
  12. NEWSLETTER – a form of sending commercial information to the customer electronically, after consenting to receiving such content.
  13. PRODUCT/GOODS – physical goods, movable items, identified as to their type, available in the pvcpro.eu Online Store, including in particular non-prefabricated goods tailored to individual needs.
  14. ONLINE STORE – a store operated at pvcpro.eu by Salpark Sp. z o.o., NIP: 5252367659, ul. Chorzowska 17, 26-600 Radom, enabling the purchase of products online.
  15. INTERNET SERVICE – services provided electronically via a telecommunications network, including the Internet.
  16. SERVICE USER – a natural person, legal person or organizational unit without legal personality, using a service provided electronically.
  17. LEGAL BASIS – provisions of the Civil Code regulating the principles of proper service to the Buyer by the Seller.
  18. ORDER – a declaration of will of the Customer expressing consent to the execution of the order in the order form within the meaning of Article 60 of the Civil Code, constituting the basis for concluding the Sales Agreement.
  19. ELECTRONIC SERVICES – operations related to online payment processing carried out by platforms such as Przelewy24 or PayU.

§ 3. LEGAL BASIS

  1. Act of 23 April 1964 – Civil Code (Journal of Laws 1964 No. 16, item 93, as amended).
  2. Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827).
  3. Act on the provision of services by electronic means of 18 July 2002 (Journal of Laws of 2002, No. 144, item 1204, as amended).

§ 4. ELECTRONIC SERVICES IN THE pvcpro.eu STORE

  1. The online store offers the following electronic services:
    1. Registration Form,
    2. Order form,
    3. User Account,
    4. Newsletter.
  2. The online payment operator is:
    1. Przelewy24
  3. The user account management service is provided free of charge and begins after registration (i.e. after completing all required fields of the registration form).
  4. The Order Form enables the conclusion of a Sales Agreement.
  5. Detailed rules for using the Newsletter service are specified in the Privacy Policy.

§ 5. CONTACT WITH THE SELLER

  1. Possible forms of contact with the Seller are:

    traditional mail, to the address: Salpark sp. z o. o., ul. Chorzowska 17, 26-600 Radom, Poland,
    by phone: +48 48 386 68 88, on weekdays from 7:00 a.m. to 3:00 p.m.

§ 6. ORDER PROCESS AND METHODS AND TERMS OF PAYMENT FOR GOODS

  1. The sales agreement may be concluded by the Customer submitting a clear declaration of intent to purchase the products offered by the Seller, indicating the quantity and specification of the goods ordered and the preferred method of payment, using the contact details provided in § 5.
  2. The Customer may also submit a declaration of intent to purchase via the IT system, i.e. directly on the Seller's website.
  3. The sales contract is concluded when the Seller confirms the order on the website. From that moment on, the parties are bound by the mutual obligations specified in § 8 and § 9. Confirmation of the order constitutes the conclusion of the sales contract.
  4. The price given on the website does not constitute an offer within the meaning of Article 66 of the Civil Code, but merely an invitation to submit offers in accordance with Article 71 of the Civil Code.
  5. All prices listed on the website are gross prices expressed in Polish zloty.
  6. Accepted payment methods are: a. Bank transfer, b. Card payment, c. Blik payment, d. Payment via an online payment operator (PayU/Przelewy24), cash (upon personal collection) or cash on delivery to a courier.
  7. Payment for your order must be made within 3 business days of placing your order. Failure to do so will result in your order being automatically canceled.
  8. When choosing payment via an online payment provider, an additional service fee may be added to the purchase amount.
  9. The Seller may post information on the website about an estimated shipping time, e.g., 48 hours from order acceptance to fulfillment. This time is provided taking into account the completion date of all ordered products. The Seller reserves the right to withdraw from the contract if the delivery time is exceeded.
  10. When ordering different products, please use the shipping time of the longest product ordered.
  11. The Seller is not responsible for delays caused by problems on the part of electronic payment operators.
  12. When choosing to pay via electronic payment operators, the regulations and general terms and conditions of these operators apply.
  13. The customer consents to electronic invoicing. This consent may be revoked at any time.
  14. The Seller reserves the right to cancel the order in the event of providing false data, non-payment or other circumstances resulting from the Customer's fault.
  15. If you order products with different delivery times, delivery will be made based on the longest estimated delivery time. These delivery times are subject to change.
  16. If, after the conclusion of the contract, changes occur that affect the price of the goods or services (e.g. an increase in customs duties or taxes), the Seller may change the price, even if this was not provided for in the contract.

§ 7. RULES FOR CONCLUDING CONTRACTS

  1. The Seller guarantees that the offered products are his property and are free from legal defects.
  2. The sales contract is concluded when the order is placed using the Order Form or another equivalent form provided for in the Regulations.
  3. The Seller declares that the product is in stock, and if it is not available, the Seller will immediately place an order with the manufacturer. The fact that the product is not in stock does not entitle the Customer to withdraw from the contract.
  4. A customer who is a consumer, in accordance with the provisions of the Civil Code, may exercise the right to withdraw from a contract concluded outside the business premises under the terms specified in the Act of 30 May 2014 - Consumer Law.
  5. The customer may withdraw from the contract by submitting an appropriate declaration.
  6. The Customer has the right to withdraw from the contract provided that the returned goods are in undamaged condition. If the goods show signs of use, the Seller has the right to reduce the refund amount.
  7. The item must be returned in a resalable condition, in its original packaging, and sealed with a protective film. Failure to meet these requirements may result in the Seller refusing to accept the return or reducing the refund amount.
  8. The Customer is entitled to a refund of delivery costs in the amount corresponding to the cheapest available shipping option offered by the Seller at the time of placing the order.
  9. The right to withdraw from the contract does not apply to products made to special order and tailored to the individual needs of the Customer.
  10. Products such as strip curtains, which are made to individual customer orders, are not returnable due to their personalization.
  11. The customer is required to provide a valid delivery address when placing the order. Changing the address after the goods have been delivered to the courier may incur additional costs.
  12. Orders placed for different products with different delivery times are shipped after the entire order is completed, i.e. according to the longest delivery time among the ordered products.
  13. The right to withdraw from a distance contract does not apply to the consumer in the case of products made to special order or tailored to his individual needs.

§ 8. SELLER'S OBLIGATIONS

  1. The Seller guarantees that the offered products are free from physical and legal defects.
  2. The goods are released upon handover to the carrier, and from that moment on, the Customer is responsible for any damage or loss of the goods.
  3. The Seller undertakes to provide the instructions for use provided by the manufacturer and to provide additional information about the product, if necessary.
  4. The Seller does not accept returns sent cash on delivery. Returns accepted by the Seller, related to complaints, are processed at the Customer's expense, after prior arrangement via email.

§ 9. DELIVERY TERMS

  1. Purchased products are delivered via courier.
  2. Shipping costs may not be included in the product price shown on the website, and the final amount will be provided later in the order process.
  3. The delivery service includes delivery of goods to the specified address.
  4. The Seller's liability for damage to goods during transport is governed by Articles 556-576 of the Civil Code. In the event of damage to the shipment, the Customer should complete a damage report with the courier and immediately inform the Seller.
  5. If the complaint is accepted and the carrier pays compensation, the Customer has the right to exchange the damaged goods for new ones.

§ 10. CUSTOMER OBLIGATIONS

  1. The customer is obliged to pay the full amount including the product price and delivery costs.
  2. All activities undertaken during the execution of the order, as well as after its execution, on behalf of a legal person require appropriate authorization to represent that person.
  3. If damage to the goods is noticed during delivery, the Customer should verify the condition of the shipment in the presence of the courier and report any damage in accordance with the carrier's procedures, otherwise the complaint regarding transport damage may not be accepted.
  4. The Customer is obliged to use the goods in accordance with their intended purpose and in accordance with the recommendations of the manufacturer and the Seller.
  5. Any noticed defects or non-conformity of the goods with the order should be reported to the Seller immediately.

§ 11. LIABILITY OF THE PARTIES

  1. The Seller is not liable for delays resulting from the fault of the carrier, and any claims in this respect are excluded.
  2. The Seller shall not be liable for delays caused by force majeure such as fire, epidemic, flood, state of emergency, strikes, armed conflicts or other unforeseeable events.
  3. The Customer is responsible for any improper use of the goods, in particular for unauthorized modifications, improper assembly, or other actions inconsistent with the instructions for use. In such cases, the Seller's liability is excluded.
  4. The Seller provides a 12-month warranty on products purchased in the store, covering manufacturing defects and damage caused by the manufacturer.

§ 12. PERSONAL DATA PROTECTION

  1. The controller of personal data of the Customers of the PVC-PRO.PL online store is Salpark with its registered office in Radom, ul. Chorzowska 17, tel.: 483866888 or 537383728, NIP: 5252367659, REGON: 140505562, e-mail: biuro@pvc-pro.pl.
  2. Contact in matters related to personal data protection is possible at the following e-mail address: biuro@pvc-pro.pl.
  3. User data is processed with their consent for the purpose of fulfilling orders.
  4. In the case of Customers who have chosen the courier delivery option, personal data will be transferred to the selected carrier for the purpose of delivery.
  5. For Customers choosing electronic or card payment, personal data will be transferred to the company handling electronic payments on the PVC-PRO.PL website.
  6. The customer has the right to view, correct, delete, limit processing and transfer their data.
  7. Any requests regarding personal data may be submitted by e-mail to the following address: biuro@pvc-pro.pl or in writing to the Seller's registered office address: Salpark sp. z o. o., ul. Chorzowska 17, 26-600 Radom.
  8. Providing personal data by the Customer in the Registration Form or Order Form is voluntary, however, failure to provide them will prevent the order from being fulfilled.

§ 13. OUT-OF-COURT DISPUTE RESOLUTION METHODS

  1. The Seller informs that it is possible to resolve disputes between the Seller and the Customer (ODR) out of court, concerning, among others, the provisions of the regulations or the concluded Sales Agreement.
  2. Extrajudicial dispute resolution can take place, among others, via the following websites:

§ 14. PROVISIONS RELATING TO ENTREPRENEURS

  1. The Seller informs that in the event of concluding a Sales Agreement with entrepreneurs within the meaning of the Civil Code who make purchases for purposes related to their business activity, they are not entitled to consumer rights.
  2. The warranty for physical defects between the Seller and entrepreneurs is excluded.
  3. The entrepreneur has the right to withdraw from a contract concluded at a distance or off-premises within 14 days of receiving the goods, in accordance with the Consumer Rights Act.
  4. In the event of late payment, the provisions of the Act on Counteracting Excessive Delays in Commercial Transactions apply.

§ 15. FINAL PROVISIONS

  1. The content of the regulations, along with the date of their publication, is available on the website of the PVC-PRO.PL store.
  2. In matters not covered by these regulations, the provisions of Polish law shall apply. In the event of a conflict between the provisions of these regulations and applicable law, the generally applicable provisions shall prevail.
  3. For the interpretation of contractual provisions and product specifications, the Polish language is binding.
  4. Each order placed in the store constitutes a separate sales contract and requires separate acceptance of the regulations.
  5. Disputes arising from contracts concluded under these regulations shall be subject to the jurisdiction of Polish courts and shall be resolved in accordance with Polish law.
  6. Agreements concluded on the basis of these regulations are drawn up in Polish.
